INVESTMENT PROPERTY TAX FREE EXCHANGES

When you buy an investment property, there are two important financial goals to consider. You will want a property capable of producing real income, and when you sell, you hope that it will have appreciated enough that you will earn a good profit on your investment. You may need to do some careful planning to avoid paying out most of your profits in the form of capital gains taxes.

The1997 tax bill allows you to exclude up to $500,000 in capital gains taxes when selling your primary residence. However, this does not apply to investment property--if you sell one property then purchase another, the taxes will be due for the year the sale occurred. On the other hand, if you arrange to exchange one investment property for another, you can defer the capital gains tax. Two types of property qualify for deferred gain treatment under Section 1031 of the Internal Revenue Code - they are: property held for investment, and property held for a productive use in a trade or business. To ensure complete tax deferment you must acquire a replacement property which is equal or greater in price than your exchange property, and move all of your equity from the old property into the new. It is not as complicated as it sounds, but you do need professional help. Many Realtors and attorneys specialize in helping their clients put these1031tax-deferred exchanges together.
